Pre-Nuptial Agreements
A Prenuptial Agreement is a means by
which individuals who intend to marry may alter their legal rights
and obligations during the marriage and/or upon divorce. These
agreements typically concern financial issues such as support and
property division. A Prenuptial Agreement must satisfy all of
the usual requirements for validity of a contract.
In Pennsylvania, Prenuptial Agreements are presumed by the courts to
be valid, though they may be challenged under certain circumstances.
The Agreement will be held valid if it either:
- makes reasonable provision for the spouse; or
- if the Agreement is entered into after full and fair
disclosure.
